MDHHS Order Oct. 9 per MCL 333.2253 - Gathering Prohibition and Mask Order
Click the link above to read the full order. In summary:
MDHHS Emergency Order, “Gathering Prohibition and Mask Order,” issued under MCL 333.2253, largely reinstates three major aspects of prior emergency orders: Requirements to wear masks at indoor and outdoor gatherings: The order requires individuals to wear masks at indoor and outdoor non-residential gatherings, and it requires businesses and government offices to enforce mask-wearing requirements on their premises. Limitations on the size of gatherings: Similar to the previous expansion of gatherings announced last week, under the MDHHS order, indoor non-residential gatherings of more than 10 and up to 500 people are allowed, with the following limits: 20 people per 1,000 square feet (25 people per 1,000 square feet in Region 6), in venues without fixed seating. According to MTA Legal Counsel, if it is determined that a meeting of a public body is going to exceed the number or capacity of persons imposed by the DHHS Order, you would either need to end the meeting or move to a larger location or go outside to continue the meeting with safe distancing. A meeting may also be recessed for no more than 36 hours without re-noticing to allow moving to a larger location. Members of the public may be given the option to use a virtual method of attending the meeting, but under the OMA, a person cannot be turned away from an open session of an open meeting if they are not disrupting that meeting.
